Terms of Service

1. The service

TalkMoxie is an AI-powered negotiation coaching application that helps you prepare for and practice conversations. Features include Game Plans, Live Coach, Practice Mode and The Last Word, a separate AI-judged debate game.

2. Eligibility and accounts

You must be old enough to form a binding agreement where you live. Provide accurate sign-up information, keep your password secure, and tell us promptly at contacttalkmoxie@gmail.com if you suspect unauthorized use. You are responsible for activity on your account.

3. Free trial and subscriptions

TalkMoxie offers paid plans (Consumer monthly, Consumer annual, Solo and Business). The current price of each plan is shown on the plan picker before you subscribe and on the Stripe checkout page. Payments are processed by Stripe.

New subscribers may receive one free trial lasting three days. A payment card is required to start the trial; nothing is charged on the day you start. We email you a reminder about 24 hours before your trial ends, so you have time to cancel. When the trial ends, the price of the plan you chose is charged automatically to your card, and then again each billing period, unless you cancel before the trial or period ends.

You can cancel anytime from your Account page via "Manage billing" (Stripe's customer portal), where you can also update your card and see invoices. If you cancel, you keep access until the end of your trial or current billing period and are not charged again. If a payment fails, AI features pause until payment succeeds; your saved work is not deleted because of billing status.

Each person may receive only one free trial; an email address that has already used a trial can subscribe without a new trial. We may refuse or end trials we believe are duplicate or abusive. Accounts that received a free trial before cards were required keep that trial until its original end time.

4. AI usage limits

Game Plan, Live Coach and Practice Mode share an allowance of 20 successful AI coaching requests per account per day. The Last Word has a separate allowance of 20 AI judging requests per account per day. Days reset at midnight UTC.

Only new AI output counts. Viewing, editing wording, or re-reading saved plans, conversations, transcripts and results does not use an AI request, and failed coaching requests are not counted. Starting AI features requires an active trial or plan.

5. AI limitations

AI-generated guidance may be inaccurate, incomplete, or unsuitable for your situation. Review it carefully and use your own judgment. You are responsible for the decisions you make in your own negotiations.

TalkMoxie provides general negotiation guidance for educational purposes, not legal, financial, or professional advice.

6. Your content

You keep ownership of what you enter, such as negotiation situations, messages, practice replies and arguments. You give us permission to store and process it, including sending it to our AI provider, only to operate the service for you. See the Privacy Policy for details. Do not submit information you do not have the right to share.

7. Third-party services

TalkMoxie relies on Stripe (payment processing and subscription management), Anthropic (AI responses), Cloudflare Turnstile (bot protection on sign-up), Google (optional sign-in and web fonts), and our hosting and database provider. Their own terms and policies also apply to their services.

8. Acceptable use

Do not use TalkMoxie unlawfully or to harass, deceive or harm others; attempt to bypass security, access controls, trial rules or usage limits; create multiple accounts to obtain additional trials; interfere with or overload the service; scrape it or reverse-engineer it; or try to extract the AI's instructions or other users' data.

9. Intellectual property

TalkMoxie, its name, logo, design and software belong to us or our licensors. We grant you a personal, non-transferable, revocable licence to use the service under these Terms. You may use AI output generated for you for your own purposes.

10. Availability and termination

We aim to keep TalkMoxie available but do not promise uninterrupted or error-free operation. We may change, suspend or discontinue features. We may suspend or close accounts that break these Terms. You may stop using the service at any time and request account deletion as described in the Privacy Policy.

11. Privacy

Our Privacy Policy explains how we handle your information.

12. Disclaimers and limitation of liability

To the extent permitted by applicable law, the service is provided "as is" and "as available" without warranties of any kind, and we are not liable for indirect, incidental, special or consequential damages, or for outcomes of negotiations you conduct. Nothing in these Terms limits rights or liability that cannot be limited under applicable law.

13. Indemnification

To the extent permitted by law, you agree to indemnify us against claims arising from your misuse of the service or breach of these Terms. [Draft language — subject to legal review.]

14. Governing law

These Terms are intended to be governed by the laws of the State of Arizona, USA, subject to final legal review and to any consumer protections that apply where you live.

15. Changes and general terms

We may update these Terms. For material changes we will give reasonable notice, for example in the app or by email, before they take effect. If any part is found unenforceable, the rest remains in effect.
